4 Registration Of Secondary Schools
9. Procedure for Registration of Secondary Schools by the Board
(1) A trust which desires to impart secondary education by establishing a school from an academic year, shall apply on or before 31st August in the previous academic year, to the Board in form-I as provided in clause (2). The board shall decide on all the applications on or before 28th of February.[1]
(2) Every application under clause (1) of this Regulation, shall be sent to the Secretary of the Board by Registered post with A.D., along with the prescribed fees. [2]
(3) The application for registration shall be entertained by the Board only if it is duly made in form. I to be obtained from the Board on the payment of fee as decided by the Board from time to time, and if the fees of Rs. 1000/- or as laid down in the Regulation 9 (2) is paid.[3]
(4) On receipt of the application, the Secretary shall forthwith forward one copy thereof to the officer for report indicating the date on or before which the report and recommendations of the officer shall reach the Board's Office. The report and the recommendations of the officer along with the application shall be placed before the Executive Committee by the Secretary after due Scrutiny, for approval.
(5) While forwarding his report under clause (4), the officer shall state whether and on what conditions the trust is registered.[4]
(6) The Executive Committee may call for any information related to consideration of the application from the applicant and the applicant shall promptly supply the necessary information through the officer.
(7) No secondary school shall be registered by the Board or continued to be registered unless it fulfills the following requirements, namely :-
(i) The management is, in the opinion of the Board, competent and reliable and is in the hands of a properly constituted authority or managing body and its financial stability is assured;
(ii) the school is open for inspection by officers of the Board, the inspecting officers of the Department, or a person authorized by the Board;
(iii) the School has, in the opinion of the Board, furniture, laboratory, library, equipments, stationary and other articles for conducting the school as per the standard requirements laid down by regulations, has non-teaching and teaching staff having qualifications prescribed under regulations, and has recreation and sanitary facilities for the students;
(iv) the education imparted in the school is, in the opinion of the Board, satisfactory in all respects, and the school employs the members who are qualified to be appointed as such as per the regulations made in that behalf.
(v) the school follows the curricula and the detailed syllabi approved by the Government and uses the textbooks sanctioned or prescribed by the Government from time to time.
(v-a) The school Management shall not permit, in the school premises, the use of text books containing question papers regarding examination along with model answers, or
explanatory notes on fundamentals with questions and answers on new edition, guides, short-notes from books meant for prompt preparation and such other books. [1]
(vi) admissions given in various standards are according to the conditions laid down by the Board under clause 10 of Section 17;
(vii) promotions from one standard to the next higher standard are given in accordance with the standards laid down by the Board under clause 10 of Seciton-17;
(viii) the rates of education fees, the pay-scales and allowances of the headmasters and teaching and non-teaching staff, and amenities provided, are in accordance with these regulations;
(ix) the school maintains satisfactorily, the registers and records prescribed by the Board;
(x) the records, statistical returns and certificates given by the school of or the management are trustworthy;
(xi) the school undertakes to make provision to the satisfaction of the Board that the general rules of discipline as laid down by the Board from time to time are duly observed by the school employees as well as by the students;
(xii) the management ensures that no unregistered school or class is conducted in the premises of the school managed by it or in other premises;
(xiii) the school shall not prepare and send one and the same candidates, for any other examination of a nature similar to or higher than the Secondary School Certificate Examination conducted by the Board;
(xiv) the school shall not refuse admission to a student on the ground only of religion, race, caste, language or any of them if the school receives grant from the State Government.
(8) (i) Where the Executive Committee is satisfied that the school deserves to be registered, in that case, the Executive Committee shall direct the Secretary to enter its name in the list of registered secondary schools to be maintained by him and the Secretary shall inform the applicant that the school has been registered, and where the Executive Committee decides that the School shall not be registered, in that case, the decision shall be communicated by the Secretary to the applicant;
(ii) Where recommendation of the officer to register or not to register the school is not accepted by the Executive Committee, the reasons therefore shall be recorded in writing.
(9) The register in Form-II shall be maintained by the Secretary of the Board.
(10) The Secretary, on a request made by a person in charge of management of a registered school may make a change in the entries in relation to a school entered in the register, after following, as far as may be, the procedure similar to the procedure for registration of the school, and obtaining the previous approval of the Executive Committee of the Board to such change.
(10-A) For change of place of a registered secondary school; [1]if
(1) The school building is old, and in dangerous condition;
(2) the school building is a rented one and if the circumstances to vacant the same arises or if a new building has been constrict with the permission of the institution and
(3) if modern facilities in better proportion have been made in the existing school building or if a building with better facilities has been kept on rent, the change of place shall be granted keeping in view, the above circumstances, if the new building for the school falls with in 1 kilometre of distance
(1) A permission in written shall be produced from more than 50% members of the guardians as well as from teachers and other employees for the change of place.
(2) the permission for such change of place shall be granted only once in a life time of the school no permission shall be granted otherwise. provided further that, in case if the school is to be shifted to it's own building, it shall not be entitled for grant for the rant of news building.
(11) One secondary school being registered a certificate of registration shall be given in form III
(12) If the management of a registered school desires to provide instruction in additional subjects or in additional medium or media of instruction as far as may be, the same procedure as that prescribed for registration shall be followed.
(12.A) The management Generally, should not refuse to allow to make use of the whole school premises or part of it along with the furniture, equipments, for the conduct of public examinations held by the Board. on request being made by the management and the Board getting satisfied, The Board should arrange for providing necessary police protection for the safety of the school building and the staff working there in during the examination period.
(13) The following shall be the standard requirements in respect of building, laboratory, library, furniture, equipments, stationary and other articles for conducting registered schools and equipments for a Secondary school. Provided that where the requirements cannot be complied with by any applicant for registration of a School, the applicant may specify in full details, special circumstances, reasons or local conditions on account of which such deficiency in or deviation from the standard requirements may be condoned.
(i) the premises should be sufficiently healthy, well lighted and ventilated, with due provision for the safety of the pupils and with separate, satisfactory and adequate sanitary
arrangements for girls in the case of a school providing co-education;
(ii) the rooms in which classes are held should provide requisite accommodation for all the students actually admitted in each class, at the rate of not less than 8 sq. ft per student i.e.,
400 sq.ft. or 40 sq. mtrs. exclusive of the space required for a table and chair for a teacher, a teaching platform, a blackboard and any other equipment required for teaching;
(iii) admissions to divisions of a standard should be limited to the number of students for which there is accommodation in the class room, subject to a maximum number of 60
(1) Provided that, in the case of standard-X, not more than 10 students who rejoin the registered school after failure at a final examination held by the Board, may be admitted with the permission from the officer in each division of standard-X. Such students shall pay the fees as prescribed from time to time. Provide further that the Officer concerned may allow at his discretion, admission to not more than 5 students in excess of 60
(2) students in a classroom where there is adequate accommodation and equipments for the Students, so allowed
(3) Provided also that the Secretary may in special Circumstances with the previous permission of the Chairman, allow the registered school to admit students in excess of the limit at laid down in the clause.
(iii-a) "The admission to the division of a standard, subject to the maximum number of 40 students in post basic schools, should be restricted to the class-room's capacity for
accommodating students, and in the developed post basic schools in the standards from VIII to X the maximum number for admission should not exceed 350 students".
(iv) Every registered school shall, as far as practicable, provide a playground within a reasonable distance from the school at the rate of one acre of land for every 250 students :
(v) Provided that the Executive Committee may, in special circumstances of a case, relax the requirement under this paragraph.
(vi) Adequate and suitable laboratory, library, furniture, equipments, stationery and other articles for conducting the school shall be provided.
(vii) In a registered school where technical, Science and vocational subjects are taught, a well equipped workshop, laboratory and equipments for practical work shall be provided and the
number of students assigned to a single teacher for practical work shall not exceed the sanctioned strength of one Division.
(14) The teaching staff of the school shall be adequate according to the strength of the students of the schools and shall be well qualified too. The alternative courses shall be provided and the optional subjects be taught. Only trained teachers possessing a degree or any other equivalent qualification in the respective subjects they teach, shall be employed; Provided that the Executive Committee may relax any of the requirements specified in this regulation in special circumstances of a registered school on the merits of its case.
(15) No new school shall ordinarily be allowed to be opened unless the Board is satisfied that it will fulfill a felt need of the locality concerned. The body proposing to start a new school will have to give convincing proofs regarding the nature of the need. [2]
(16) No new school shall ordinarily be allowed to be opened in a locality if the Board is convinced that it is likely to result in unhealthy and/or unfair competition with an existing institution within a reasonable distance, which in rural areas may be taken as [3] 5 Kms. If, as a consequence of starting of a new school, any school already in existence in the same locality suffers a loss of more than 20 percent in its enrolment this would be considered as a positive proof of unhealthy competition having occurred, and the Board may, on this basis only, recommend that no grant should be paid to such a newly opened school.
(17) As far as possible, the opening of new schools will be related to the population of the area, and the existing norm of one secondary school for every 3000 of population may be continued. The Educational survey will also be kept in mind while deciding new applications. Areas which are already saturated with secondary schools will have to produce very strong reasons for starting another school. this provision may, however, be relaxed in the case of remote and cut-off areas, where the population is mostly of Adivasis or backward classes. Even there, the limit of 5 kms will normally be adhered to.
9-A . Inquiry procedure for cancellation of the name of the Schools from the register of Secondary Schools
(1) (1)If the Board feels that the person, in charge of the administration of the registered school (hereinafter referred to as the "manager") has defaulted in discharge any of the duties imposed on him under the Act or Regulations, or in complying with any of the instructions given to him by the Board and there is a prima facie case for inquiry into such matter, under sub-section (9) of section 31, the Board may order the Secretary of the Board or any other officer of the Board (1) not below the randk of the Secretary of the Board to inquire into the matter.
(2) (2) The Inquiry Officer shall serve the manager with a charge sheet containing the details of alleged defaults committed by the manager, and the evidence in support thereof, and shall order the manager to furnish explanation regarding each accusation mentioned in the charge sheet within 10 days from the date of the receipt of such charge sheet.
(3) The Inquiry Officer, after taking into consideration, the reply of the manager and after making further inquiry which he thinks suitable, shall order the administrator to provide more required information within the time-limit to be specified in the notice. The Inquiry Officer through such notice, may order the manager to inform whether he is willing to have personal hearing. The Inquiry Officer shall inform the manager about the place, time and date for hearing in person. The Inquiry Officer, after hearing the manager in person or after taking into consideration the information furnished by him in the event of his being absent on the date and time fixed for hearing, shall prepare his inquiry report on the basis of the inquiry made by himself. In such report he shall, invariably mention the defaults committed by the manager along with the reasons evident for his conclusions. The Inquiry Officer shall also make the specific recommendations in the report about the actions to be taken against the manager.
(4) The Inquiry Officer shall submit such report to the Executive Committee of the Board. The Executive Committee shall examine the report and put it under consideration and the concerned Inquiry Officer, shall make further inquiry, as the Committee thinks proper. Thereafter, the Committee if provisionally comes to such a conclusion that the manager is at fault, it may serve a show-cause notice to the manager and ask for an explanation as to why the name of the school should not be cancelled from the Register, within the time limit as specified in the notice. Such notice should also contain the reasons for agreement or disagreement of the Committee with the findings of the Inquiry Officer, and it should also mention the evidence and other information on the basis of which the cancellation of the name of the school from the Register was intended. The Committee, on receipt of the explanation submitted by the manager, shall go through it and consider about it being satisfactory or not. The Committee, after going through and considering the explanation, so concludes that the manager has failed to comply with any of the duties imposed upon him under the Act or Regulations, or any of the instructions issued to him by the Board and thereby has committed default, the Board may so order that the name of the school should be cancelled from the Register for the period specified in that order, or permanently.
10. Procedure for starting numberarise or additional classes
(1) (A) No manager of a registered school shall open Std. X in such school except with the prior permission of the Secretary.
(B) No manager of a registered school shall open Std. XI or any additional divisions of the existing standard without prior permission of the Commissioner.
(2) (A) An application for permission to open a higher standard or higher standards should be submitted to the Commissioner at least 6 months before commencement of the academic year
from which it is proposed to be opened.
(B) Similarly an application for the permission to pen a new division or additional divisions of the existing standard should be submitted to the Commissioner within a month from the
commencement of the academic year.
(3) (A) No permission to open Std. X shall be given by the Secretary unless he is satisfied that the manager is ready and willing to make adequate provision in relation to additional class-rooms,
laboratory, library, furniture, equipments, stationery and other articles required for conducting Std. X.
(B) No permission shall be granted to open Standard X or additional divisions of existing standard unless the Commissioner is satisfied that the management is ready and willing to make
adequate provisions in relation to additional class-rooms, laboratory, library, furniture, equipments, stationery and other articles required for conducting additional classes.
(4) The provisions of this regulation shall apply to division of a class for better internal organisation except in a case where such division does not result in increase in the number of divisions already sanctioned for the relevant standard.
(5) The manager, if permitted to open a higher standard or higher standards or additional divisions of an existing standard shall take necessary action to effect alteration in the relevant entries in the register.
(6) No Managing Committee shall stop the teaching for any reason nor shall resort to strike.
10-A. Reduction in the total number of classes
No manager of a registered school shall effect any reduction in the total number of classes in the school without the written prior permission of the officer. For this purpose, the manager shall have to make an application at least one month before the date from which he intends to reduce the number of classes. Furthermore, no manager shall effect any reduction in the teaching staff owing to the reduction in the total number of classes in the school without prior written permission of the officer. Before giving such permission, the officer shall hear both the parties, namely the manager and the teachers or teacher concerned.
Note :- The term 'class' or 'classes' in these regulations shall mean the class or classes of certain specific standard and specific medium of instructions.
11. Channel of correspondence
(1) The Head of each registered secondary school shall make correspondence with the Board regarding the matters concerned with academic and administrative matter, and it shall be the duty of the Head to keep the managing body of the registered secondary school informed about the correspondence.
(2) The name and address of the Head of the school shall be registered within fifteen days from the date of his appointment, in the office of the Board.
(3) Where the management desires a person other than the Head of the registered school, who is a member of the managing body of the school, to be in charge of the correspondence for attending to financial matters of the school, it shall inform the Secretary of the Board. The name and address of such person in charge of correspondence shall be registered with the office of the Board within 15 days from the date of such appointment. In the case of any change of the person handling such correspondence for financial matters, the name and address of the person so changed shall be registered with the office of the Board.
